These Terms & Conditions ("Terms") govern your access to and use of the Trawelio platform and related services (the "Service") operated by Cookie Webster Co., Ltd. ("we", "us", or "our"). By creating an account, starting a trial, or using the Service, you agree to these Terms.
1. The Service
Trawelio is a software-as-a-service platform that helps tour and activity operators build booking websites, manage catalogs, accept reservations, and run their businesses online. We provide the platform; each operator is solely responsible for the tours, prices, availability, and customer relationships they publish through their workspace.
Customer payments for tours and experiences are processed through payment providers connected by the operator (for example Stripe, Omise, and Pay Solutions). Unless stated otherwise in your subscription plan, Trawelio does not collect booking payments on behalf of operators and does not take a commission on tour sales.
Platform subscription and setup fees are processed through Omise. Payment terms for your subscription are described in these Terms and our Cancellation Policy.
2. Accounts & eligibility
You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old and legally able to enter into a binding contract. You may not use the Service for unlawful purposes, to infringe intellectual property, to distribute malware, or to interfere with the platform or other users.
3. Subscriptions, trials & fees
Paid plans, trial periods, and billing intervals are described on our pricing pages and in your workspace. New operator accounts include a 14-day free trial. To start a trial, you must provide a valid payment method (card or another supported method) at signup. No subscription charge is taken during the 14-day trial.
When the trial ends, your selected plan fee is charged automatically through Omise unless you cancel before the trial period expires. Subscription fees are then billed in advance according to your plan. Failure to pay may result in suspension or termination of your workspace.
Once a paid billing period has started after the trial, subscription fees are non-refundable. You may cancel at any time; access continues until the end of your current paid period. See our Cancellation Policy for full details.
Optional setup or migration services, if purchased separately, are governed by the quote or checkout terms presented at the time of purchase.
4. Operator content & customer bookings
You retain ownership of content you upload (tours, images, text, policies). You grant us a limited licence to host, display, and process that content solely to operate the Service. You are responsible for ensuring your listings, prices, and policies comply with applicable laws and that you have rights to use all materials you publish.
Contracts for tours and experiences are between the operator and the end customer. Trawelio is not a party to those bookings unless we explicitly state otherwise in writing.
5. Acceptable use
You agree not to misuse the Service, attempt unauthorised access, scrape the platform beyond permitted APIs, overload our infrastructure, or use the Service to send spam or misleading offers. We may suspend or terminate accounts that violate these Terms or pose a security or legal risk.
6. Availability & changes
We aim to keep the Service available but do not guarantee uninterrupted access. We may modify features, pricing, or these Terms. Material changes will be communicated where practicable; continued use after changes take effect constitutes acceptance.
7. Disclaimer & limitation of liability
The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill arising from your use of the Service.
Our total liability for any claim relating to the Service is limited to the fees you paid us for the Service in the twelve (12) months before the event giving rise to the claim, except where liability cannot be limited under applicable law.
8. Termination
You may cancel your subscription at any time from your workspace billing settings or by contacting us. Cancellation stops future renewal charges. You may continue using the Service until your current paid subscription period expires. We may suspend or terminate access for breach of these Terms, non-payment, or legal requirement. Upon termination, your right to use the Service ends; we may delete or retain data as described in our Privacy Policy and applicable law.
9. Governing law
These Terms are governed by the laws of Thailand. Disputes shall be subject to the exclusive jurisdiction of the courts of Thailand, unless mandatory consumer protection rules require otherwise.
